Rental Agreement Valid for Short-Term Rental Properties
Parties and Purpose of the Agreement
With this contract, the rights and obligations of the parties are determined in the rental processes between the person, individual or legal entities (hereinafter referred to as “Customer”) who rent the accommodation places such as villas, apartments, bungalows, summer houses, etc. (hereinafter referred to as “Property”) and Hisarlar Petrol Gıda İnşaat Turizm ve Ticaret Ltd. Şti. (hereinafter referred to as “Olea’s”), which mediates the rental processes of these Properties.
The Property subject to the contract has been rented for vacation purposes for a period of time with predetermined start and end dates. Customers and their accompanying persons who book any of the Properties offered for sale on www.oleas.com.tr through digital or traditional channels (e.g. web page, call center via corporate line or e-mail) are deemed to have accepted the following terms in advance. Violation of any of the following conditions gives Olea’s the right to unilaterally cancel the reservation, to ask the Customer to leave the rented Property, not to refund the deposit, deposit rental fee and to demand the full amount of the unpaid rental fee.
Pre-Booking, Reservation, Prepayment and Payment Processes
Short-term rental properties offered for sale can be pre-booked via the relevant screens on our website www.oleas.com.tr, via the call center, by phone or by e-mail. Pre-booking process will be made by Olea’s for the properties for which rental conditions have been determined and which are desired to be rented, by clarifying the dates to be rented and informing the Customer of the necessary reservation information. After the pre-booking, Olea’s may request a deposit, i.e. prepayment, with rates ranging from 15% to 40% against the rental transaction. Following the payment of the prepayment, i.e. the down payment, the relevant Property will be reserved and converted into a reservation. Following the transfer of the required prepayment amount to the bank account number, the Customer is informed via e-mail, SMS or other communication channel. Within the following 1 business day, the booking confirmation and remaining payment details are shared with the Customer and the invoicing of the service received is made. In the event that the prepayment/down payment is not deposited within the specified period, Olea’s has the right to cancel the pre-booking and take another reservation instead without the obligation to inform the Customer.
After booking and payment confirmation, the Client pays the remaining payment in cash to the relevant person/officer upon receipt of the contracted Property on the day of check-in. A damage deposit may be charged upon check-in. This fee will be refunded to the Customer if there is no problem or damage in the general check to be made before the check-out time.
In order to prevent any victimization that may arise due to the reasons mentioned, we remind you that it is important to have these deposit amounts in cash on the day of check-in.
Price and Payment
The rental fees specified on the advertisement detail pages can be determined daily, weekly or monthly. Prepayment / deposit can be made to the relevant company bank accounts by Wire Transfer, Eft, Credit Card or Mail Order payment method.
Pre-Booking, Reservation, Payment, Cancellation and Refund Policy
Following pre-booking, prepayment is requested at rates determined by Olea’s. These rates may vary according to the Properties in question, details are available on the rental and payment screens. Reservations are finalized after the prepayment is made to the relevant bank accounts.
Balances other than the prepayment of finalized reservations must be paid in advance on the day of arrival at the Property.
The customer can cancel the reservation until the 20th business day before the date of accommodation. The guest must notify Olea’s of the cancellation in writing. Notifications not made in writing are not accepted as they cannot be justified. In the event of cancellation, Olea’s may charge a percentage of the total cost of the services to cover the costs of the services undertaken in connection with the trouble-free stay. These amounts are determined as follows.
For prepaid and finalized reservations, Olea’s will refund 50% of the pre-booking amount for cancellations made up to the 20th business day before the check-in date. For cancellations between the 20th business day and the check-in date, the prepayment amount (Eft, Money Order, Credit Card or Mail Order) is not refundable for any reason whatsoever.
If for any reason the reservation is canceled by Olea’s, the Client will be notified as soon as possible. If there is an equivalent Property available in the portfolio on the same dates, it will be offered. In case the Client does not approve this alternative, the payments made will be refunded.
Reservation and Date Change
Reservations made through www.oleas.com.tr have the right to make changes in case of availability. For these changes, it is obligatory to comply with the following points;
a. Changes are only valid for the Property booked. The confirmation of the reservation change is realized with the approval of the Property owner.
b. In case of possible price difference and prepayment amount changes due to date changes, the customer agrees to pay the difference to be reflected.
c. Discounts and promotions used at the time of booking, if any, may be canceled.
Invoice and Tax Responsibilities
None of the Properties published on www.oleas.com.tr belong to the relevant legal entity. The Properties offered for rent may be owned by different persons, individuals, organizations, companies, etc. Olea’s is an agent who acts as an intermediary (broker) to rent these Properties, which belong to different persons, individuals, institutions and companies, to customers. Therefore, Olea’s is only obliged to issue a brokerage (commission) invoice. That is, it earns a certain brokerage profit from the prepayment fee paid by the client and invoices this amount. The remaining amount cannot be invoiced as it belongs to the property owner. The property owner pays tax to the government at the end of the year under the name of rental income declaration. In this context, Olea’s is obliged to invoice only for the brokerage commission it earns. It cannot invoice for the profit earned by third parties, institutions, individuals, companies. It is absolutely not responsible for this situation. It cannot be held responsible.
Damage Deposit
Damage deposits may vary according to the characteristics of the Properties offered for rent on www.oleas.com.tr. The amount of the deposit is written on the relevant sales screens at the reservation stage and in the payment information section of the reservation form sent. The damage deposit can be collected at the pre-booking stage, or it can be collected in cash on the day of arrival at the Property and based on the signed usage agreement. The damage deposit will be refunded on the day of departure if the fixtures delivered complete and intact are received complete and intact after the checks made by the relevant officer on the day of departure. In the event that the customer wishes to leave the Property at an earlier time than specified in the contract and the exit control cannot be carried out due to the intensity, the deposit will be sent to an account number to be received from the customer. If the damage to the property exceeds the amount of the deposit received, the customer will be asked to pay this damage, otherwise legal action will be taken.
Cleaning, Maintenance and Extra Charges
Property rental prices include entrance cleaning as specified at the time of booking. For stays of 14 days or more, weekly cleaning, towel/linen etc. change is included in the prices. Apart from this, any cleaning and towel / sheet etc. change to be requested is subject to extra charge. Pool and garden maintenance is carried out early in the morning every day, and any technical problems specific to the Property during the rental process will be resolved by Olea’s. During this process, it may be necessary for the relevant personnel on duty to enter the garden or inside the Property in order to carry out maintenance and repair of the Properties and other equipment in question. In order for these services to be carried out, the Customer must allow the staff on duty to enter the accommodation premises when necessary. Electricity, water, bottled gas, pool lighting, internet connection and air conditioning usage of the relevant Properties are included in the prices unless otherwise stated in the detail section of our advertisements on our website. Pool lighting, air conditioning and internet connection may not be available in every Property. For this reason, we recommend that you carefully examine the facilities offered by the rented properties on the advertisement details pages.
Entry – Exit Hours
Check-in time to the rented properties is 14:00 or 16:00 (depending on the property) at the earliest and 22:00 at the latest on the day of the booked check-in. In order to check in outside the specified hours, the Client must inform in advance the approximate check-in time and obtain confirmation. The customer may not enter the Property outside the specified hours without prior notification and approval. If the customer does not arrive during the specified hours, he/she may enter at the beginning of the working day (09:00) on the next day if the entry hours are not complied with. In the event that the customer arrives before or after the specified time, Olea’s cannot be held responsible for any problems arising from the inability to enter the Property, overnight accommodation, inability to find accommodation, etc. In this case, any material / moral obligations that may arise belong to the Customer. Olea’s is not and cannot be held responsible for such situations.
Check-out time at the end of the stay is 10:00 in the morning at the latest. It is important to comply with the check-in and check-out times in order not to be victimized on both sides of the holiday plans. In case of early check-out, 24 hours prior information is required. In the event that the customer checks out before the check-out check is made on Olea’s initiative due to the intensity, the damage deposit will be sent to the bank account to be notified by the customer. In the event that the customer leaves the Property early at his/her own discretion, no refund of accommodation or deposit will be made.
Number of People Designated for Accommodation, Property Capacity
The Properties where accommodation will be made do not accept guests above the capacity specified on the website or other sales channels during the reservation phase or above the number of people specified during the reservation phase. This capacity includes children and babies. If the customer wishes to make a change in the number of people after the reservation is finalized, Olea’s will be applied in writing and this change will be approved if deemed appropriate according to the capacity of the Property. If the number of people exceeds the accommodation capacity, the customer may be charged an additional fee. After entering the rented property, it is strictly forbidden for any person other than the guests specified in the reservation list to stay. In cases where persons other than the specified guests are detected, Olea’s has the right to ask the guests to leave the Property, to cancel the reservation completely or to demand the Property to be completely vacated without waiting for the end of the rental period, to demand the full fee or extra fee. During the rental of the property, transactions are carried out in accordance with the customer’s declaration and the customer declares that the information provided is correct and complete and accepts all responsibilities arising in this regard.
Pet Related Situations
Pets are not allowed in the accommodations except for the properties with pet permits specified in the ad details. For Properties where pets are not allowed, if the guest brings a pet, the relevant accommodation will not be accepted and entry will not be made.
Cigarette Use
Smoking is strictly forbidden in all indoor areas of the Properties in accordance with the relevant laws and regulations.
Use of Swimming Pools
The swimming pool temperatures of the properties where accommodation is provided vary according to the weather and seasonal temperature. Olea’s cannot be held responsible for the rental Customer’s inability to use the pool due to the coldness of the pool. The Customer who will rent the Property can visit the web address of the General Directorate of State Meteorology to find out the weather information on the date of rental or they can get information by phone.
General Customer Responsibilities
a. Customers are obliged to use all electrical and electronic equipment, furniture, etc. delivered to them in a sound and working condition and to keep the pool and garden furniture clean.
b. Customers are obliged to leave all kitchen utensils etc. delivered to them clean in the same way.
c. On the day of check-out, all garbage in the Property must be disposed of and dishes must be washed. In addition, if the Property is left excessively dirty and filthy, as is sometimes the case, the cleaning fee will be deducted from the damage deposit.
d. In the event of any damage to the rented property, the customer is obliged to notify Olea’s and inform them in detail.
e. Any damage to the Property during the stay of the customer will be deducted from the amount of the damage deposit for any damage, loss, damage and lost fixtures and fittings. If the damage exceeds the amount of the damage deposit, the Client may be requested to pay in cash.
f. Customers and their guests should take care to comply with social and moral rules, not to make noise in a way that disturbs the environment, not to listen to loud music, not to engage in behaviors that are prohibited by the laws of our country and constitute a crime.
g. In the event of complaints about the Customer and its guests for such reasons, Olea’s has the right to ask the Customer to vacate the Property before the end of the reservation period.
Important Note; Olea’s cannot guarantee 100% invisibility for our guests who will be staying in the properties specified on the rental detail pages and defined as “conservative” (pool not visible from the outside). In such cases, the Customer must ensure their own privacy. In these cases, Olea’s does not accept responsibility and cannot be held liable.
The Tenant must read, understand and sign the rental agreement issued by Olea’s at the entrance to the Property. If the relevant contract is not signed by the Customer, the prepayment collected during the reservation process will not be returned to the customer and the accommodation will not be realized. The rental agreement may be terminated unilaterally by Olea’s. In addition, Olea’s has the right to demand all fees in the contract. The customer can request 1 copy of this contract from [email protected] e-mail address or from the authorized person on the day of check-in.
Our Responsibilities as Olea’s
Olea’s is responsible for delivering the rented properties to the customer clean and ready for use on the specified date and time. If there are any faulty, broken, non-working items at the entrance to the property, the customer must notify us and request that these problems be eliminated. Olea’s will notify the property owner or the relevant company of the defects and will ensure that these defects are eliminated as soon as possible. Olea’s is not responsible for the elimination of the disruption, but is responsible for helping to eliminate the disruption. Our company is not responsible for disruptions that are not reported on time. Olea’s is an intermediary between the property owner and the customer. For this reason, Property owners are responsible for the elimination of any problems that may occur. Apart from this, Olea’s cannot be held responsible for any accidents, illnesses, injuries, drowning in the pool, death, theft, etc. and fire, theft, etc. that may occur in the Property. In addition, Olea’s cannot be held responsible for the problems arising from the services such as travel, shopping, food and beverage, entertainment, transportation, travel, guidance services, etc. that the customer will receive from third parties / companies during the holiday.
Important Information
a. Olea’s is not responsible for the conditions such as broken, uphill, stabilized, wet ground, etc. on the roads leading to the rented property.
b. Olea’s cannot be held responsible for any accidents etc. that may occur during transportation to the rented property.
c. Olea’s cannot be held responsible for the different materials used in the construction and architecture of some properties (cedar wood, pine wood, plastic products, plants used in the garden or inside the accommodation spaces, etc.) if they affect the customer negatively in terms of health or psychological aspects.
d. Customers who will stay in our Properties may need a private vehicle. The transportation of our Customers to the rented Properties is their own responsibility.
e. The Client may obtain a taxi, transfer vehicle or rental car from any firm/company or person. Olea’s is not involved in these services, all positive / negative situations are the Customer’s own responsibility.
f. Our company cannot be held responsible if the Customer who rents the property is dissatisfied due to the geographical location of the vacation home he / she has rented.
g. The location of the property to be rented through www.oleas.com.tr is approximately marked on Google Map or the relevant map infrastructure.
h. The customer cannot hold Olea’s responsible for any damage to his/her private or rented vehicle during transportation to the rented property.
i. The distances showing the distances of the advertisements on www.oleas.com.tr are written approximately. There is a small margin of error. The customer agrees to take this into consideration.
j. Olea’s cannot be held responsible for negative situations such as drowning, falling, broken arms that may occur in the pool in the rented holiday home.
k. Olea’s is not responsible for fire, electrical leakage, tube leakage and death and accidents that may occur as a result of these situations in the rented property caused by the Customer. Olea’s cannot be held responsible for interruptions caused by the electricity infrastructure, telephone or internet provider.
l. Olea’s cannot be held responsible for complaints that the appearance of the Properties offered for evaluation on the detail pages of www.oleas.com.tr are not exactly the same as the advertisement photos, that they look more striking on the web page, that they are photographed larger due to the lenses used on the site, etc., taking into account that professional shots are taken.
m. Olea’s cannot be held responsible for unusual situations such as scorpion, insect stings, dog bites, etc.
n. During and after the reservation stage, in cases such as funerals, death, weddings, health problems, accidents, cancellation of leave of public or private company personnel, etc., the rental conditions are valid and there is no cancellation.
The renting Customer has accepted all the conditions clearly stated above in advance and in the event that he/she tries to cancel the rental agreement by putting forward different excuses, Olea’s may use the right to terminate the contract alone and demand the entire accommodation amount.
Complaints and Negativities
Customers will report their complaints to Olea’s during their stay at the Property. The complaint will be investigated and necessary measures will be taken quickly. Olea’s will not be held responsible for any complaints that are not reported during the stay and after leaving the Property after the end of the stay.
Extraordinary Circumstances
In extraordinary circumstances, Olea’s and the Customer may mutually terminate this agreement without any legal liability. This situation can be considered as wars in the country, natural disasters in the region where accommodation will be made, epidemics throughout the country, etc.
Privacy and Security Policy
Olea’s cannot share or disclose personal information and data to any company or third parties, except as defined in this privacy and security policy use agreement. This confidential information and data cannot be sold to third parties. Personal information is only Name – Surname, Address, Phone, E-Mail etc. details are the information used to identify customers. Olea’s keeps personal information private and confidential, and undertakes to take the necessary measures and care to prevent disclosure to a third party in order to ensure and maintain confidentiality.
Dispute and Dispute Situation
Antalya Courts are authorized in all disputes that may arise regarding the subjects and scopes covered by this contract.
